Special Conditions

Reservations for short term holiday accommodation are accepted by Cape Executive Holiday Properties office at 4a Dunn Bay Centre 31-33 Dunn Bay Rd, Dunsborough or PO Box 747 Dunsborough WA 6281 (Accommodation Manager) as the manager for the Owner of the Property and to which the following terms and conditions shall apply:

Accommodation Contract

The Accommodation Contract is between the Guest and the Owner of the property for which the accommodation booking is made and is subject to the terms and conditions herein. the contract for accommodation shall not be effective until the Accommodation Manager send the Guest written confirmation of the Booking. The Guest acknowledges that the Accommodation Manager acts as a Manager for the Owner only and not as a principal.

Deposit

The accommodation booking will not be confirmed by the Accommodation Manager until the Guest's deposit payment is received and cleared. A deposit of 30% of the accommodation charge is due within ten (10) days to secure all bookings. Payment of this constitutes the guest acceptance of the booking terms and conditions. The deposit amount can be paid using VISA or MASTERCARD, Cheque, Money order or Directed Debit.

Final Payment

We advise that the balance of monies are due TWO WEEKS priorto arrival date for ALL bookings. This amount includes your security bond.

Please note that check in time is from 2pm from our office at Shop 4a Dunn Bay Centre, 31-33 Dunn Bay Road, Dunsborough across the road from Dunsborough Video; next door to Epic Swells and I Love Betty.

However, should you be arrive in Dunsborough after office hours on 5pm, we will place the keys in a bag with your name on and leave it behind the bar at The Cape Wine Bar.

The Cape Wine Bar is located on Naturaliste Terrace l next door to the Old Dunsborough Bakery. Should you have any difficulties finding the bar their telephone number is 9756 7650. You can collect the keys from as late as 10pm to 12pm. (Alternative arrangements can be made with Management prior to arrival if these arrangements don't suit)

Additional features (if any)

If additional features such as a swimming pool, outdoor spa or other facilities are shown in the brochure, on the website as being available at the property concerned, the Guest acknowledges that the use of any additional amenities is entirely at the Guest's risk and neither the Accommodation Manager nor the Owner shall accept any responsibility for any injury loss or damage to property or any third party arising from the use thereof.

Guests property

All personal belongings, luggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and neither the Accommodation Manager or the Owner accepts any responsibility for any loss or damage thereto.

Guest's Obligations in Respect of the Property

The Guest shall be responsible for the Property during the Guest's stay. The Guest shall take all reasonable care of the property and at the end of the stay shall leave the property including all utensils, fixtures, equipment and fittings, in or about the Property in a clean, tidy and undamaged condition. The Guest shall be liable for any breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest's occupation of the Property that do not constitute general wear and tear. All costs of repair and replacement thereof shall be payable to the Accommodation Manager or the Owner upon demand. Any damage or breakage to any part of the property or any of the chattels therein shall be reported to the Accommodation Manager as soon as practical after the damage has occurred. Should additional cleaning or a special rubbish bin clearance be required the cost will be deducted from the bond .

Party Size and Disturbance

The Guest may only allow the property to be occupied by the number of persons nominated in the Guest's application and under no circumstances shall the number of people occupying the Property be greater that that appearing on the Guest's Booking Form. The Accommodation manager reserves the right to refuse occupation of the Property to the Guest if the condition on the number of people intended to occupy the property is not observed. Disturbance to our neighbours, including excessive noise is prohibited, and may result in the termination of rental. We trust that you will accept this as a reasonable request as many holiday houses have neighbouring permanent residents.

Availability of Property

Should any events whatsoever arise beyond the reasonable control of the Accommodation Manager which render the property uninhabitable (example flood, fire, storm, tempest or the property is sold) then the Accommodation Manager may have to cancel the booking with a full refund payable to the applicant. Should such circumstance arise then the Accommodation Manager will endeavour to relocate the Guest to a holiday home of similar standard in the same area. Where this is not possible, all monies paid by the Guest will be refunded in respect to the property. Upon refund of the monies paid, the Guest shall have no further claims whatsoever against the Owner of the property or the Accommodation Manager.

Cancellation Policy

Once your booking has been confirmed and receipted by Cape Executive Holiday Properties your deposit is non-refundable. If the booking is cancelled in writing more than 30 days from the date of commencement of your holiday you will be released from the liability for the full balance of hire. The deposit will be refundable less a $100 booking fee if we are successful in finding guests to fill your place at the holiday home. If you give written notice of cancellation less than 30 days prior to the date of commencement of your holiday and we are successful in finding guests to fill your place at the holiday home you will be released from the liability for the full balance of hire. The deposit is non-refundable.

Right to Refuse or Revoke Bookings

Cape Executive Holiday Properties reserve the right to revoke or refuse to honour any property accommodation booking which may in their opinion (and at their sole discretion) be unsuitable for the property.

Representations

The Guest acknowledges that Accommodation Manager has used its best endeavours to describe the property to the Guest within the limited extent of the communications and will not be liable to the Guest in any respect should the Guest consider the property to be unsuitable for any reason whatsoever.

Description of the Property

All information in respect of the Property contained in the Accommodation Manager's website and/or brochure is believed to be correct at the time of the printing, however all details contained in the website and/or brochure are subject to change by the Accommodation Manager and/the Owner without notice. The Accommodation Manager will not accept any responsibility for any alterations to the Property or any part thereof beyond the Accommodation Managers control or any liability for any matter or occurrences beyond the Accommodation Managers reasonable control including damage caused by extreme weather conditions, break down of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

A Service fee covers the initial prep of the property, all bed linen, bathroom linen and the clean after you vacate. (We don't supply Beach Towels)

A Cleaning fee is for the clean after you vacate.

Arbitration

Should any dispute arise between the Booking Agent and the Guest which cannot be mutually resolved the matter will be referred to arbitration by a single arbitrator agreed to by the parties, but failing agreement upon a single arbitrator, then a single arbitrator appointed by the President for the time being of the Real Estate Institute of Western Australia (Inc) who shall act as sole arbitrator in accordance with the provisions of the Commercial Arbitration Act 1985 as amended and whose decision shall be final and binding on the parties.

Residential Tenancies Act Not Applicable.

The Guest and the Owner acknowledge and agree that the Rental Agreement to which these conditions apply is bona fide entered into for the purposes of conferring on the Guest a right to occupy premises for a holiday within the meaning of Section 5 (2) (e) of the Residential Tenancies Act 1987 as amended ("the Act") and the parties to the Agreement confirm that the provisions of the Act shall not apply to the Rental Agreement.
